2. Nature of Products and Assumption of Risk
2.1 Uniqueness and Variation
Every item offered by ROKUYA is a handcrafted work created by an independent Japanese artisan. No two pieces are identical, even when produced by the same artist using the same techniques. Variations in glaze, color, texture, shape, and size are inherent characteristics of the craft and are considered features, not defects. Kiln effects such as yōhen (窯変, kiln transformation), hidasuki (火襷, fire marks), and koge (焦げ, natural scorching) are valued aesthetic qualities in Japanese ceramics tradition.
2.2 Photographs and Descriptions
Product photographs are taken under controlled lighting and may not perfectly represent the item's appearance under all conditions. While ROKUYA makes every effort to provide accurate descriptions and images, the inherent nature of handcrafted items means the received product will differ from the photograph in some respects. Where significant characteristics are present (e.g., intentional asymmetry, notable surface variations), ROKUYA will make reasonable efforts to document and communicate these prior to sale.
2.3 Curation Service — Expectation Management
For items procured through ROKUYA's Curation Service, ROKUYA exercises professional judgment in selecting items that match the client's stated requirements, aesthetic direction, and budget. However, handcrafted items are inherently unpredictable, and the final delivered items may differ from reference photographs, samples, mood boards, or verbal descriptions discussed during the consultation phase. ROKUYA does not guarantee that the delivered items will match the client's subjective expectations. Disagreement with ROKUYA's aesthetic judgment does not constitute grounds for return, refund, or cancellation.
2.4 Product Use and Safety
ROKUYA occasionally provides care instructions and usage guidance based on information from the artist. It is the buyer's responsibility to follow these instructions. Unless specifically noted, handcrafted ceramics should be assumed NOT to be dishwasher-safe, microwave-safe, or oven-safe. Some ceramic glazes may contain materials that are not certified as food-safe under all international standards. If food safety certification is important to your intended use, please inquire before purchase. ROKUYA is not liable for any injury, damage, or loss resulting from improper use, handling, or storage of purchased items.
2.5 Independent Artisans
ROKUYA sources products from independent artists. These artists are not employees, agents, or representatives of tmz Co., Ltd. ROKUYA does not control the artists' creative processes, production schedules, or business practices. Any representations about an artist's work, history, or techniques are made in good faith based on information provided by the artist and ROKUYA's own research.
3. Ordering and Payment
3.1 Inventory Sales
Orders for in-stock items are placed through direct communication with ROKUYA via Instagram DM, email or any other written communication channels. Once your order is confirmed, ROKUYA will issue a secure payment link via the selected payment method. Payment of the full purchase price is required in a single transaction. An order is binding once payment is successfully processed. All prices include international payment processing costs, otherwise ROKUYA will inform customers prior to each purchase.
3.2 Curation Service
Curation Service engagements proceed as follows:
Consultation and Proposal: ROKUYA consults with the client to understand requirements, budget, aesthetic direction, and timeline. ROKUYA then prepares a detailed procurement plan specifying the proposed items, artists, quantities, estimated costs, and delivery schedule.
Order Confirmation: The engagement is formally confirmed when the client signs a written order form ("Order Form") issued by ROKUYA. The Order Form constitutes a binding agreement. Verbal agreements, informal messages, or unsigned proposals do not constitute a binding order.
Payment Schedule: Payment is made in three phases via the selected payment method:
- Phase 1 — 50% Deposit: Due upon signing the Order Form. ROKUYA will commence procurement from Japanese artists and suppliers only after this payment has been received and confirmed. No orders will be placed with artists until the deposit is received.
- Phase 2 — 30% Progress Payment: Due upon receipt of ROKUYA's written notification that the procured items are ready for shipment from Japan. ROKUYA will dispatch the shipment from Japan only after this payment has been received and confirmed. ROKUYA is not liable for any delay of arrival due to any delay associated with customers’ payment timing.
- Phase 3 — 20% Final Payment: Due upon delivery of the items to the client's designated address in Thailand and completion of the client's inspection. This needs to be made within two working days of arrival date.
Each payment will be invoiced separately by ROKUYA, with payment to be completed within the timeframe specified in the invoice.
3.3 Pricing
- Prices for Inventory Sales are set at the time of payment link issuance.
- Prices for Curation Service are set in the Order Form. The Order Form price includes estimated import duties, customs fees, VAT, and logistics costs based on information available at the time of quotation. If actual import-related costs assessed by Thai customs authorities or government agencies differ from the estimates included in the Order Form, the difference (whether higher or lower) will be passed through to the client at actual documented cost. ROKUYA will provide official customs receipts or equivalent documentation to substantiate any such adjustment.
- ROKUYA reserves the right to adjust pricing for future orders at any time without prior notice.
- For Inventory Sales, the listed price is the final price payable by the customer. No additional import-related charges apply, as all import costs have been absorbed by ROKUYA.
4. Cancellation Policy
4.1 Inventory Sales — Cancellation
Once payment has been successfully processed, the order is final and cannot be cancelled. No refunds will be issued for completed purchases of in-stock items.
If payment is not completed within the validity period of the issued payment link, the order is automatically cancelled and the item may be made available to other customers without further notice.
4.2 Curation Service — Cancellation
Due to the bespoke nature of Curation Service engagements — in which ROKUYA commits financial resources to artists and suppliers on the client's behalf — the following cancellation terms apply:
Before ROKUYA places orders with artists/suppliers: If the client requests cancellation after signing the Order Form and paying the Phase 1 deposit, but before ROKUYA has placed orders with artists or suppliers, ROKUYA will refund 70% of the deposit. The remaining 30% of the deposit will be retained as an administrative fee covering consultation, planning, and sourcing work already performed.
After ROKUYA has placed orders with artists/suppliers: Once ROKUYA has placed orders with artists or suppliers — which may occur at any time after receipt of the Phase 1 deposit — the full deposit (50% of the total contract value) is non-refundable. ROKUYA has committed these funds to artists and cannot recover them.
After production has commenced: If the client requests cancellation after the artist has commenced production, the client is liable for all costs incurred to that point, including but not limited to: the full Phase 1 deposit, artist production costs, materials costs, and any logistics costs already committed. ROKUYA reserves the right to invoice the client for costs exceeding the deposit amount, and such invoices are payable within 14 calendar days.
After Phase 2 payment (shipment preparation): Once Phase 2 payment has been made and the shipment has been dispatched from Japan, cancellation is not possible. The client is obligated to accept delivery and pay the Phase 3 final payment.
General conditions: All cancellation requests must be submitted in writing via email to official@rokuya-jp.com. Cancellation requests made verbally, or via informal messaging channels, will not be accepted. The effective date of cancellation is the date on which ROKUYA receives the written request. ROKUYA will confirm whether orders have been placed with artists within 3 business days of receiving a cancellation request.
5. Import, Export, and Customs
5.1 Cross-Border Supply Chain
All items sold by ROKUYA are sourced from Japanese artists and suppliers, exported from Japan, and imported into Thailand through ROKUYA's appointed logistics provider. Customs clearance, import duties, VAT, and all import formalities are managed by ROKUYA's logistics provider on ROKUYA's behalf. Customers usually are not required to interact with customs authorities and are not required to perform any import-related procedures.
5.2 Import Costs — Inventory Sales
For in-stock items, all import-related costs — including customs duties, VAT, customs brokerage fees, and logistics charges — have been absorbed by ROKUYA and are included in the listed sale price. The price displayed to the customer is the final price. No additional import-related charges will be assessed by ROKUYA, unless custom authorities directly contact customers.
5.3 Import Costs — Curation Service
For items procured through ROKUYA's Curation Service, the Order Form includes estimated import-related costs based on the anticipated customs classification and applicable duty rates at the time of quotation. If actual import-related costs assessed by Thai customs authorities, government agencies, or regulatory bodies differ from the estimates included in the Order Form — whether due to reclassification of goods, changes in duty rates, additional inspections, or other regulatory actions — the difference will be passed through to the client at actual documented cost. ROKUYA will provide official customs receipts, duty assessment notices, or equivalent documentation to substantiate any such adjustment. Adjustments may result in either an additional charge or a credit to the client.
5.4 Customs Classification
ROKUYA's products are generally classified under the following Harmonized System (HS) codes for customs purposes:

The final classification of any item is determined by the Thai customs authority. ROKUYA's logistics provider prepares customs declarations based on the nature and characteristics of each item, but ROKUYA cannot guarantee the classification adopted by customs.
5.5 Customs Documentation
ROKUYA and its logistics provider will prepare accurate customs declarations and commercial invoices reflecting the actual transaction value of all imported items. ROKUYA does not undervalue items on customs declarations. Any request for false or reduced customs valuations will be declined.
5.6 Export Compliance
ROKUYA complies with all applicable Japanese export control laws and regulations. Items sold by ROKUYA are consumer goods and works of craft or art, and are not subject to export restrictions under Japanese law.
6. Shipping and Delivery
6.1 Logistics Pathway
All products — whether from inventory or procured through Curation Service — follow the same logistics pathway:
- Items are shipped from Japan to Thailand by ROKUYA's appointed logistics provider, who handles customs clearance and import formalities.
- Items are received at ROKUYA's inspection facility in Thailand.
- ROKUYA conducts quality inspection, verifying condition and conformity with the order.
- Items are packaged with ROKUYA branding and shipped to the customer's designated address via domestic courier within Thailand.
6.2 Transfer of Risk
All international shipping risk (Japan to Thailand) is borne by ROKUYA. Items are inspected at ROKUYA's facility in Thailand before dispatch to the customer. Risk of loss or damage transfers to the customer upon delivery to the customer's designated address by the domestic courier in Thailand.
6.3 Delivery Responsibilities
ROKUYA is not responsible for delivery delays caused by domestic courier disruptions, incorrect address information provided by the customer, or the customer's failure to receive the delivery.
7. Returns, Exchanges, and Refunds
Please refer to the separate Return & Replacement Policy for full details. In summary:
- All sales are final due to the one-of-a-kind nature of products.
- Claims are accepted only for items that arrive at the customer's address with damage attributable to domestic shipping, reported within 48 hours of delivery with photographic evidence.
- Identical replacements are not possible. Alternative arrangements may be offered at ROKUYA's discretion.
8. Intellectual Property
8.1 ROKUYA Brand and Content
The name "ROKUYA," associated logos, visual identity, and all original content created by tmz Co., Ltd. — including but not limited to product photographs, written descriptions, marketing materials, social media posts, curation proposals, procurement plans, and artist profiles — are the intellectual property of tmz Co., Ltd. No part of ROKUYA's original content may be reproduced, distributed, modified, displayed publicly, or used for commercial purposes without the prior written consent of tmz Co., Ltd.
8.2 Ownership of Physical Objects vs. Intellectual Property
Purchasing an item from ROKUYA grants you ownership of the physical object. It does not grant any intellectual property rights over the design, form, or artistic expression embodied in the work. Intellectual property rights related to the artistic design, form, technique, and aesthetic expression of each piece remain with the respective artist unless otherwise agreed. You may not commercially reproduce, replicate, or create derivative works based on the design of a purchased item. You may photograph your purchased item for personal, non-commercial use. For commercial use of images, please contact ROKUYA for permission.
8.3 Curation Service — Intellectual Property
ROKUYA's Curation Service involves substantial intellectual effort, including but not limited to: researching and identifying suitable artists, composing product selections, developing aesthetic concepts and coordination proposals, negotiating with artists and suppliers, and designing procurement strategies. All curation proposals, procurement plans, mood boards, product selection documents, and related materials prepared by ROKUYA for a Curation Service engagement are the intellectual property of tmz Co., Ltd. These materials are provided to the client solely for the purpose of evaluating and executing the engagement with ROKUYA. The client may not:
- Share, distribute, or disclose ROKUYA's curation proposals or procurement plans to any third party without ROKUYA's prior written consent.
- Use ROKUYA's proposals, product selections, or artist recommendations to source similar or identical items through any channel other than ROKUYA.
- Reproduce or adapt ROKUYA's curation concepts for use in other projects without ROKUYA's involvement.
8.4 Non-Circumvention and Artist Protection
This section is a material term of every transaction with ROKUYA.
ROKUYA has developed its artist network through years of personal relationship-building, trust, and mutual respect with Japanese artisans. These relationships are a core business asset of ROKUYA and are essential to the livelihood and creative independence of the artists themselves.
By purchasing from ROKUYA or engaging ROKUYA's Curation Service, you agree to the following:
Prohibition on Direct Contact for Commercial Purposes: You shall not directly or indirectly contact, solicit, or engage any artist, workshop, kiln, or supplier introduced to you through ROKUYA — whether by name, portfolio, or any identifying information obtained through ROKUYA's services — for the purpose of purchasing, commissioning, or procuring artisanal goods, or for any other commercial purpose, without ROKUYA's prior written consent.
Prohibition on Competing Sourcing: You shall not use information obtained through ROKUYA (including but not limited to artist names, workshop locations, production techniques, pricing structures, or supply chain details) to establish, operate, or assist any business that competes with ROKUYA's sourcing, curation, or distribution of Japanese artisanal goods.
Protection of Artists: This provision exists not only to protect ROKUYA's business interests but also to protect the artists. ROKUYA's artists have entrusted ROKUYA to represent their work internationally under agreed terms that respect their creative process, pricing, and production capacity. Unsolicited direct contact from ROKUYA's customers — particularly with commercial intent — places undue pressure on artists, disrupts established agreements, and may jeopardize the artist's relationship with ROKUYA to the detriment of all parties.
Duration: The obligations set out in this Section 8.4 remain in effect for permanent period of following the date of your most recent transaction with ROKUYA.
Remedies: Any breach of this Section 8.4 entitles ROKUYA to seek all available legal remedies, including but not limited to injunctive relief, actual damages, and disgorgement of profits derived from the circumventing activity.
8.5 Artist Profiles and Biographical Information
ROKUYA provides biographical information, career histories, and descriptions of artistic techniques for the artists whose work we carry. This information is compiled in good faith based on publicly available sources, information provided directly by the artists, and ROKUYA's own research. The specific compilation, translation, and presentation of this information is ROKUYA's original work and may not be reproduced in full without permission.
8.6 Third-Party Trademarks
Any third-party trademarks, brand names, or logos referenced in ROKUYA's materials are the property of their respective owners and are used solely for descriptive and informational purposes.
9. Limitation of Liability
- In no event shall ROKUYA's (tmz Co., Ltd.'s) total liability exceed the purchase price paid by the customer for the specific item(s) giving rise to the claim.
- ROKUYA shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to loss of use, loss of data, loss of profits, business interruption, or emotional distress.
- ROKUYA does not represent or warrant that any item will appreciate in value, maintain its condition indefinitely, or serve any investment purpose.
10. Force Majeure
ROKUYA shall not be held liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to: natural disasters, epidemics, war, government actions, carrier disruptions, customs delays, changes in import regulations, or supply chain interruptions affecting our artisan partners.
11. Privacy
ROKUYA collects and processes personal data in accordance with the Privacy Policy. By placing an order, you consent to the collection and use of your data as described therein.
12. Modifications
ROKUYA reserves the right to update these Terms of Service at any time. Continued use of ROKUYA's services after changes constitutes acceptance of the revised terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Japan. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court.
